LSK Vows Next Options if Masengeli Defies Court’s Jail Order

LSK Vows Next Options if Masengeli Defies Court’s Jail Order

The Law Society of Kenya (LSK), along with legal experts and civil society groups, has vowed to take further action against Acting Inspector General of Police Gilbert Masengeli if he fails to honor a six-month jail sentence issued by the High Court.

The mounting pressure follows Justice Lawrence Mugambi’s decision to sentence Masengeli for defying seven court orders related to the disappearance of Bob Njagi, Aslam Longton, and Jamil Longton—three men abducted in Kitengela two months ago by individuals who identified themselves as police officers.

LSK President Faith Odhiambo condemned Masengeli’s refusal to comply, warning that his defiance sets a “dangerous precedent” for law enforcement.

“The court has jurisdiction over the Acting IG, and there are other constitutional avenues we will consider,” she said. “The LSK’s role is to uphold and defend the rule of law.”

Despite the High Court’s directive to produce the missing men, Masengeli has repeatedly failed to appear, citing operational duties. However, his social media activity contradicts this, showing him attending public events, including a concert and the Agricultural Society of Kenya (ASK) show.

Family members of the missing victims have been left distraught. Nurwin Fozia, a cousin of one of the victims, expressed frustration: “It’s been nearly a month. The IG has ignored six court orders to provide information on their whereabouts. This is turning Kenya into a banana republic.”

Masengeli briefly addressed the situation in Garissa, refusing to discuss the case in detail, stating, “We cannot discuss matters before the court,” but reaffirmed his commitment to the rule of law and human rights.

Former LSK President Nelson Havi warned that if Masengeli fails to surrender to the Commissioner-General of Prisons within the next seven days, “he will be deemed a fugitive, and we expect Interior CS Kithure Kindiki to arrest him.”

The Usalama Initiative, an NGO focused on police reforms, criticized Masengeli’s disregard for the court, with Executive Director Caleb Wanga calling it a continuation of impunity seen under former Interior CS Fred Matiang’i. Wanga added, “Masengeli may ultimately pay a personal price for violating the Constitution.”
