Kithure Kindiki Explains IEBC Delay, Urges Legal Resolution
Deputy President Kithure Kindiki has clarified that a court order is responsible for delaying the reconstitution of the Independent Electoral and Boundaries Commission (IEBC).
During a church service in Kakamega County on Sunday, December 8, Kindiki explained that a legal challenge filed by some Kenyans has halted the formation of a recruitment panel meant to appoint new IEBC commissioners.
He urged the petitioners to consider resolving the matter outside of court to allow the IEBC reconstitution process to move forward.
“The absence of an IEBC is due to some Kenyans going to court. There’s an injunction against forming the recruitment panel tasked with appointing commissioners,” Kindiki stated. “We request the involved parties to explore an out-of-court resolution so that the process can proceed, and we can finalize reconstituting the IEBC quickly,” he added.
Kindiki emphasized that the country operates under the rule of law and, therefore, the government should not be blamed for the delays caused by the legal case.
Meanwhile, former Deputy President Rigathi Gachagua, speaking in Kasarani, Nairobi, on the same day, called for the immediate reconstitution of the IEBC. Gachagua warned that the delay could create doubts about the credibility of future elections.
“An election’s credibility depends on the process. The Kriegler report recommended that the electoral commission be established three years before the election. With only two and a half years left, people may suspect foul play if this delay continues. We demand the urgent reconstitution of the IEBC, even if it should have happened yesterday,” Gachagua asserted.
These remarks come amidst growing calls from leaders and citizens for a swift resolution to ensure the electoral body’s readiness for upcoming elections.
