Havi Claims Gachagua Plans to Resign if Impeachment is Quashed
Former Law Society of Kenya (LSK) president Nelson Havi has sparked discussions on the political future of Deputy President Rigathi Gachagua, following his impeachment and subsequent court battles.
On Monday, October 21, Havi weighed in on Gachagua’s decision to challenge his ouster in court, offering a perspective that suggests the Deputy President may not be fighting to retain his position but to protect his political future.
In a tweet that drew widespread attention, Havi hinted that Gachagua’s legal maneuvers are more about mitigating the long-term consequences of impeachment rather than securing his continued service as Deputy President. He argued that Gachagua, like any prudent politician, is simply safeguarding his political standing.
“Leave room for an adversary to run away. It is doubtful Rigathi Gachagua wants to continue serving as DP. He is fighting the legal consequences of impeachment, an action any prudent person would take,” Havi explained. His remarks suggest that Gachagua’s battle is not rooted in holding onto power but ensuring that his political future remains intact.
According to Kenya’s legal framework, an impeached individual is barred from holding any state office or contesting in an elective position for 10 years. This is likely the driving force behind Gachagua’s court actions. Havi elaborated that if the High Court rules in favor of Gachagua and quashes the impeachment, the Deputy President may choose to step down voluntarily rather than remain in office.
“He will resign after the impeachment is quashed or fight to the Supreme Court,” Havi added, indicating that Gachagua is fully aware of the legal hurdles ahead and might be preparing for a calculated political exit.
