DPP to Decide if President Ruto Will Testify in Misleading Funeral Image Case
A university student, David Oaga Mokaya, charged with spreading false information by sharing an image of a funeral procession with misleading captions, has requested the Director of Public Prosecutions (DPP) to reassess the charges.
Lawyer Danstan Omari, representing Mokaya, raised concerns about whether President William Ruto might be summoned as a witness.
“The charges revolve around posting an image of a casket on Twitter. I’ve formally asked the DPP to reconsider this case, as it touches on the citizen’s right to critique their president,” Omari stated in court.
The Law Society of Kenya (LSK) has also questioned the jurisdiction of the case, as Mokaya was arrested in Eldoret, and it remains unclear if the President will testify.
“The accused was apprehended in Eldoret, so the jurisdiction of this court must be clarified. Additionally, we want to confirm if the President, though not listed, will appear as a witness,” the court heard.
The case has been adjourned to January 28, 2025, when the jurisdiction issue will be resolved.
The DPP alleged that Mokaya, under the X account name “Landlord @bozgabi,” shared a doctored image on November 13, 2024. The post falsely implied that President Ruto’s body was being transported from a funeral home.
The manipulated image featured a casket draped in the Kenyan flag, escorted by military officers in ceremonial attire, misleadingly suggesting it was related to the President.
