Court Upholds Uhuru Kenyatta’s Jubilee Party Leadership in Landmark Ruling
Former President Uhuru Kenyatta scored a significant legal victory after the Court of Appeal dismissed an appeal filed by the Kanini Kega-led faction seeking to overturn a High Court decision that reinstated Kenyatta’s leadership of the Jubilee Party.
The Kega group, including Joshua Kutuny and the National Disciplinary Committee of Jubilee, had filed an urgent request for interim stay orders against a previous ruling by Justice Janet Mulwa. The faction sought to delay enforcement of the decision, which upheld the leadership of Kenyatta and his allies, pending their appeal’s resolution.
However, on November 11, a three-judge bench comprising Justices Jamila Mohammed, Mumbi Ngugi, and Fred Ochieng denied the request. “Counsel for the applicants urged us to grant an interim order of stay of the judgment of the High Court pending the determination of this application. In the circumstances of this application, we decline to grant interim orders of stay pending the delivery of the ruling,” the bench declared.
The decision effectively solidifies the High Court’s earlier ruling, which recognized the rightful leadership of the Jubilee Party under Kenyatta. This includes the reinstatement of David Murathe as chairperson, Kagwe Gichohi as treasurer, and Jeremiah Kioni as secretary-general, returning control to Kenyatta’s team.
The High Court had also issued a separate ruling mandating seven Jubilee Party leaders who opposed Kenyatta’s leadership to relinquish their public offices or party positions. Justice Nduma Nderi ruled their dual roles violated constitutional principles, stating, “Holding concurrent positions in public office and the Jubilee Party NEC undermines constitutional requirements for impartiality and accountability.”
Despite this setback, the Kega-led faction’s appeal remains active, with the final judgment set for March 7, 2025.
This victory underscores Kenyatta’s resilience in the face of attempts to wrest control of the party he founded. With his leadership reaffirmed, Jubilee Party’s direction is firmly back in his hands.
