Court Shields Gakuya and Mejja Donk from Arrest in Gen Z Protest Inquiry
The High Court has issued orders preventing the police from arresting or detaining two Members of Parliament, Embakasi North MP James Gakuya and Embakasi Central MP Benjamin Mejja Donk, as part of the ongoing investigation into the funding of Gen Z protests.
On July 31, Gakuya and Mejja Donk were picked up from Parliament buildings for questioning regarding their alleged involvement in funding the protests. Both MPs are known allies of Deputy President Rigathi Gachagua. In addition to the lawmakers, three aides associated with Gachagua have also been questioned in connection to the same issue.
Fearing imminent arrest, Gakuya and Mejja Donk moved to court seeking protection. Justice Chacha Mwita responded by issuing orders that effectively block any attempts by the police to arrest or detain the two MPs. The court’s decision provides temporary relief to the lawmakers as they navigate the legal challenges posed by the investigation.
Justice Mwita’s orders, dated August 5, 2024, state: “That in the meantime, a conservatory order is hereby issued restraining the respondent, their agents or servants from arresting, detaining, confining, pursuing and or in any other way interfering with the petitioner’s liberty in connection with the allegations giving rise to this petition.”
This court order ensures that Gakuya and Mejja Donk remain free until further directions are issued. The court has scheduled to provide more guidance on the matter on September 17, 2024. This date will be crucial in determining the next steps for both the MPs and the investigators.
The investigation into the funding of the Gen Z protests has drawn significant attention, especially given the involvement of prominent political figures closely associated with the Deputy President.
